Sidecars emerged as an alternative to newco reinsurers during the hard market after Hurricane Katrina in 2005. Many industry observers are predicting that the series of tragic natural disasters over the past several months may trigger a renaissance of sidecars. This article provides an overview and checklist of the critical issues connected with forming a reinsurance sidecar as a tool to practitioners. Conlon Volume: 18 Number: 4 Issue: Fall 2011 Page: 9 Abstract: Following the devastating aftermath of Hurricanes Katrina, Wilma and Rita between 2004 and 2008, residential building was at its height. During this period, given the overwhelming demand placed on domestic drywall manufacturers, suppliers turned to the international market. The result -- the use of defective Chinese drywall in over 100,000 homes, primarily in the Southeastern portion of the country. As property and bodily injury claims began to surface, homeowners, developers, builders, suppliers and manufacturers turned to their insurance carriers for coverage, both in the first-party (homeowners) and third-party (commercial general liability) context. Many of these claims are being denied by insurers, leading to a surge in Chinese drywall litigation across the country. This article chronicles the rise of Chinese drywall coverage litigation, the preliminary judicial response, and a discussion of the implications such litigation may have on the reinsurance industry.
